I bought my 03 S approximately 3 months ago with 79,000 on it. When the car is parked overnight the following morning the brakes stick on take off and don't stick anymore after that. Do i need new brakes or could it be my e-brake.

Your brakes are likely fine. This car's rear brakes tend to be very suseptible to moisture rusting the pads to the rotors. This is particularly evident if you have just washed the car and used the ebrake to hold the car. In places of high humidity or in places where you may have just driven in rain or snow and then park the car with the ebrake applied, you will get this "CRACK" when you first move off the next day. There isn't much you can do about this except perhaps don't use the ebrake when you park, especially if you've just washed the car. However, if you park on an incline, it is important to have 2 ways to hold the car - ebrake and leaving it in gear.
Cracking the brakes loose in the morning does absolutely no harm. It's just a fact of S2000 life. Don't worry about it.
The first time this happened to me was when I washed the car. I went to move it and the noise it made scared the $%it out of me. Don't worry your car is fine. It is just breaking the "rust" loose between the pads and rotors.

This is probably the case I do wash my car alot. It has been snowing on and off here.

it scared the $%it out of me too.This is the first honda that i've owned so i don't know much about the S.

This is yet another noise with this car not to worry about :)
Don't think of them as noises... think of them as music to your ears and lean to enjoy it.
Am I the only one that enjoys the horrid brake squeal from race pads? :D

The hum of the release bearing in neutral, clutch engaged.
The rhythm of the valvetrain at idle under the hood.
Intake whistle at just the right rpm under just the right load.
Secondary air injection pump whining after a cold start if you park the car outside below freezing overnight.
Initial whine of the fuel pump priming after keying ignition ON.
Possible clutch buzz when decelerating under engine braking in the lower gears as you pass through about 4000 rpm down to about 1500 rpm.
If you are sitting there idling in neutral with the clutch out, then immediately engage first gear, you will get a "thump". This is just your tranny coming to a sudden stop after spinning around in neutral. To avoid the thump, push in clutch and wait about 3 seconds before shoving stick into 1st or select 4th, then 1st.
Creaking sounds from the suspension when you go over speed bumps. This is just the bushings "talking" to you. Not a big deal. Spray everything under there with Silicone if it really bugs you.
Oh, you do know what ABS tick is, right?
Not so much a sound, but if you take a hard right hander under throttle, you may blow clouds of smoke out the exhaust. This is just oil being sloshed into the PCV line or front breather line. No big deal. Check you oil frequently and install a Krankvent or catch can if it bothers you.
Due to the high camber of the suspension, you will likely wear out the inner parts of the rear tire tread before the outer parts. The front tires tend to last twice as long as the rears unless you track the car a lot.
All of the above are "normal".
The below may not be normal .....................
A single click as you move off after changing directions. This is a rear hub nut that needs to be tightened with the higher recommended torque.
Moderate to severe vibration from the rear under acceleration. This would indicate worn and pitted CV joints.

to be honest and not a smart a**, i would think something is wrong if this didn't happen, i have owned 4 hondas prior to the s, and i have never had one that didn't pop on the first movement after a humid day or a car wash.
